Depth Services and DEP Token (DEP) are not available in the Mainland China, United States or other prohibited jurisdictions.
Welcome to Depth (the "Interface" or "App"),a website-hosted user interface (the ”Interface” or ”App”) provided by Moon Tech Limited (”we”, ”our”, or ”us”). The Interface/App is a community-driven platform governed by and belongs to a Depth decentralized autonomous organization (“DAO”) governance mechanism that is constantly improving. The App allows users to swap certain digital tokens using a variety of different smart contract protocols on the HECO/BSC Blockchain.
This Terms of Service Agreement (the "Agreement") explains the terms and conditions that govern your access to and use of the App. Please read the Agreement carefully. By accessing the App, you accept and agree to be bound by and to comply with the Agreement, including the mandatory arbitration provision. If you do not agree to the terms of the Agreement, you must not access or use the interface/App.

1.Modification of this Agreement

We reserve the right, in our sole discretion, to modify this Agreement from time to time. If we make any modifications, we will notify you by updating the date at the top of the Agreement and by maintaining a current version of the Agreement at All modifications will be effective when they are posted, and your continued accessing or use of the app will serve as confirmation of your acceptance of those modifications. If you do not agree with any modifications to this Agreement, you must immediately stop accessing and using the app.


To access or use the Interface, you must be able to form a legally binding contract with us. Accordingly, you represent that you are at least the age of majority in your jurisdiction (e.g., eighteen years old) and have the full right, power, and authority to enter into and comply with the terms and conditions of this Agreement on behalf of yourself and any company or legal entity for which you may access or use the Interface.
By accessing and using Depth services, you represent and warrant that you have not been included in trade embargoes or economic sanction list (such as the united nations security council sanctions list), the list of specially designated nationals maintained by OFAC(the office of foreign assets control of the u.s. department of the treasury), or the denied persons or entity list of the U.S. department of commerce or any other prohibited countries. Depth reserves the right to choose markets and jurisdictions to conduct business, and may restrict or refuse, in its discretion, the provision of Depth services in certain countries or regions. The list prohibited countries can be checked here.
Our Interface is NOT offered to persons or entities who reside in, are citizens of, are incorporated in, or have a registered office in the United States of America, Mainland China or any restricted territory.
We do not make exceptions. If you are a restricted person, then do not attempt to access or use the Interface. Use of a virtual private network (e.g., a VPN) or other means by restricted persons to access or use the Interface is prohibited.
You further represent that your access and use of the App will fully comply with all applicable laws and regulations, and that you will not access or use the Interface to conduct, promote, or otherwise facilitate any illegal activity.
As a condition to accessing or using the Services or the Site, you: (i) will only use the Services and the Site for lawful purposes and in accordance with these Terms; (ii) will ensure that all information that you provide on the Site is current, complete, and accurate; (iii) will maintain the security and confidentiality of access to your Distributed Ledger Technology Address; and (iv) agree (A) that no Protected Party (defined below) will be responsible for any loss or damage incurred as the result of any interactions you have with other users of the Site, Services or the Depth protocol, including any loss of the tokens issued by Depth (“DEP Tokens”), any other tokens or other unit of value; and (B) if there is a dispute between you and any other site or other user, no Protected Party will be under any obligation to become involved.
Non-Circumvention. You agree not to access the Interface using any technology for the purposes of circumventing these Terms.

3.Prohibited Activity

You agree not to engage in, or attempt to engage in, any of the following categories of prohibited activity in relation to your access and use of the Interface:
  • Intellectual Property Infringement. Activity that infringes on or violates any copyright, trademark, service mark, patent, right of publicity, right of privacy, or other proprietary or intellectual property rights under the law.
  • Cyberattack. Activity that seeks to interfere with or compromise the integrity, security, or proper functioning of any computer, server, network, personal device, or other information technology system, including (but not limited to) the deployment of viruses and denial of service attacks.
  • Fraud and Misrepresentation. Activity that seeks to defraud us or any other person or entity, including (but not limited to) providing any false, inaccurate, or misleading information in order to unlawfully obtain the property of another.
  • Market Manipulation. Activity that violates any applicable law, rule, or regulation concerning the integrity of trading markets, including (but not limited to) the manipulative tactics commonly known as spoofing and wash trading.
  • Securities and Derivatives Violations. Activity that violates any applicable law, rule, or regulation concerning the trading of securities or derivatives.
  • Any Other Unlawful Conduct. Activity that violates any applicable law, rule, or regulation of the United States or another relevant jurisdiction, including (but not limited to) the restrictions and regulatory requirements imposed by U.S. law.

4.No Professional Advice

All information provided by the Interface is for informational purposes only and should not be construed as professional advice. You should not take, or refrain from taking, any action based on any information contained in the Interface. Before you make any financial, legal, or other decisions involving the Interface, you should seek independent professional advice from an individual who is licensed and qualified in the area for which such advice would be appropriate.

5.Assumption of Risk

By accessing and using the Interface, you represent that you understand the inherent risks associated with using cryptographic and blockchain-based systems, and that you have a working knowledge of the usage and intricacies of digital assets such as Bitcoin (BTC), Tether (USDT),Binancecoin (BNB), and other digital tokens such as those following the HECO and BSC Token Standard (HRC-20, BEP-20).
You further understand that the markets for these digital assets are highly volatile due to factors including (but not limited to) adoption, speculation, technology, security, and regulation. You acknowledge and accept that the cost and speed of transacting with cryptographic and blockchain-based systems such as Binance Smart Chain are variable and may increase dramatically at any time.
You further acknowledge and accept the risk that your digital assets may lose some or all of their value while they are supplied to the Protocol through the Interface, you may suffer loss due to the fluctuation of prices of tokens in a trading pair or liquidity pool, and, especially in expert modes, experience significant price slippage and cost. You understand that anyone can create a token, including fake versions of existing tokens and tokens that falsely claim to represent projects, and acknowledge and accept the risk that you may mistakenly trade those or other tokens.
You further acknowledge that we are not responsible for any of these variables or risks, do not own or control the Protocol, and cannot be held liable for any resulting losses that you experience while accessing or using the Interface. Accordingly, you understand and agree to assume full responsibility for all of the risks of accessing and using the Interface to interact with the Protocol.
You acknowledge and agree that Moon Tech Limited has no control over any Distributed Ledger Technology transactions.The Depth smart contract is an open source computer protocol containing the Depth Smart Contract Implementations relating to Swaping, Staking, and Voting. You should note that the Depth Smart Contract is not developed by us, and the we have no control or influence over the Depth Smart Contract or any of the functions or changes to functions thereof.


We do not guarantee that the Site will be secure or free from bugs or viruses.
You are responsible for configuring your information technology, computer programmes and platform in order to access the Site. You should use your own virus protection software.
We cannot promise that the use of the Site, or any content taken from the Site, will not infringe the rights of any third party.
The Site may contain hyperlinks or references to third party websites. Any such hyperlinks or references are provided for your information and convenience only. We have no control over third party websites and accept no legal responsibility for any content, material or information contained in them. The display of any hyperlink and reference to any third-party website does not mean that we endorse that third party's website, products or services. Your use of a third-party site may be governed by the terms and conditions of that third-party site.
We are not responsible for the quality, accuracy, timeliness, completeness or reliability of any of the digital token information on the App. You are obligated to collect sufficient information and keep yourself well informed before trading any digital tokens on the App.

7.Entire Agreement.

The Terms constitute the entire agreement between you and us with respect to the subject matter hereof. The Terms supersede any and all prior or contemporaneous written and oral agreements, communications and other understandings—if any—relating to the subject matter of the Terms.
